Terms of Service

1. Acceptance of Terms

By accessing, browsing, or using any TAP CRE LLC ("TAP CRE," "we," "us," or "our") websites, platforms, applications, or related services (collectively, the "Services"), you ("User") confirm that you have read, understand, and agree to be bound by these Terms of Service ("Terms") and our Privacy Policy.

IF YOU DO NOT AGREE, DO NOT USE OUR SERVICES.

You represent and warrant that you are at least 18 years of age and have the legal capacity to enter into this agreement.

2. Description of Services

TAP CRE provides licensed real estate brokerage services, including property listings, investment advisory, market analysis, transaction facilitation, and related communication and educational resources. We may modify, suspend, or discontinue any Services at any time without notice.

3. Use License & Restrictions

3.1 Limited License

You receive a limited, non-exclusive, non-transferable, revocable license to use our Services solely for lawful business purposes relating to real estate.

3.2 Prohibited Uses

You must not engage in any unlawful, fraudulent, disruptive, or harmful activity. This includes, without limitation: data scraping, system interference, impersonation, unauthorized access, or use of our Services to harass or exploit others.

3.3 Account Security

If an account is created, you are responsible for maintaining confidentiality and immediately notifying us of unauthorized use.

4. Intellectual Property

All content and technology used in our Services is owned by TAP CRE LLC or licensed providers and is protected under applicable laws. "TAP CRE" and all associated branding are registered or pending trademarks. Use of MLS or third-party data remains subject to their respective licensing rules.

5. Property Information & Disclaimers

  • Listing information is believed accurate but not guaranteed.
  • Data may originate from MLS (including Realcomp), property owners, or third-party providers.
  • You are responsible for conducting independent due diligence and consulting licensed professionals before making any decisions.

6. Disclaimer of Warranties

ALL SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND.

7. Limitation of Liability

Maximum liability of TAP CRE Parties is limited to the greater of $100 or the total amount paid to TAP CRE in the 12 months before the claim.

8. Indemnification

You will defend and indemnify TAP CRE Parties against claims arising from your misuse, breach of Terms, or related conduct.

9. Real Estate–Specific Terms

  • Michigan Real Estate Brokerage License: MI License No. 6505433487
  • Agency: No agency or fiduciary relationship arises from website use. Agency only exists if separately executed in writing.
  • MLS Compliance: MLS data is for consumer non-commercial use only. Resale or redistribution is prohibited.
  • Fair Housing: TAP CRE adheres strictly to all federal, state, and local fair housing and anti-discrimination laws.
  • Commissions and Fees: Governed solely by written agreements.

10. Privacy & Data

Handled under our Privacy Policy. Communications may be sent to you; you may opt out anytime.

11. Modifications & Termination

Terms may be modified at any time. Continued use constitutes acceptance. We may terminate access without notice if a breach occurs.

12. Dispute Resolution

  • First attempt: Written notice to info@tapcre.com
  • Then: Binding arbitration under AAA rules, held in Wayne County, Michigan
  • Class actions and jury trials are waived.

13. Governing Law

State of Michigan, excluding conflict of law principles. Remaining litigation venue: state or federal courts in Wayne County, Michigan.

14. General Terms

These Terms constitute the entire agreement. If any clause is unenforceable, the remainder still applies. Force majeure protections included.
